Extraordinary Abilities in Arts or Extraordinary Achievement in motion picture or TV


Introduction

The O-1B visa is for individuals who have extraordinary abilities in arts or extraordinary achievement in motion picture or television industry (MPTV).

Requirements

To qualify for an O-1B (Arts) visa, the beneficiary must have sustained national or international acclaim and has achieved distinction in the field of arts. To be more specific, the petitioner must establish that the beneficiary:

  • Has extraordinary ability in the arts which has been demonstrated by sustained national or international acclaim;
  • Has achievements that have been recognized in the field through extensive documentation; and
  • Is coming to continue work in the area of extraordinary ability, even if the specific tasks don’t always require that level of ability.

To qualify for an O-1B (MPTV) visa, the beneficiary must have a record of extraordinary achievement in the motion picture and television industry such that he or she has a very high level of accomplishment evidenced by a degree of skill and recognition significantly above the norm, making them recognized as outstanding, notable, or leading in the field. To be more specific, the petitioner must establish that the beneficiary:

  • Has demonstrated a record of extraordinary achievement in motion picture or television productions; and
  • Is coming to continue to work in such productions. However, the productions need not require someone with a record of extraordinary achievement.

Period of Stay

The maximum initial stay is 3 years       

Extensions

You can apply for an extension of up to 1 year at a time. You must submit proof that your employment is ongoing, and you generally must include updated evidence of your extraordinary ability.
